Terms and Conditions
Last updated: October 26, 2026
These terms govern your use of Highlights (the website highlights.ai, the Highlights apps for iPhone and Android, and the trip plans we deliver) and anything you buy from us. Highlights is provided by Winding.ai Inc ("we", "us"), 1887 Whitney Mesa Drive #5338, Henderson, NV 89014, USA (support@winding.ai). By using Highlights you agree to these terms, so please read them carefully.
Some provisions apply only to consumers, only to business users such as travel advisors, or only to people in certain countries, and they say so. Everything else applies to everyone.
What Highlights is
Highlights makes travel plans with AI. You can describe a trip and get a day-by-day plan, edit it by chatting with Sally, share it with one link, plan with a group, and buy ready-made plans or a custom plan made for you. Highlights is a planning tool: we don't sell or book travel such as flights, hotels, tours or tickets, and we're not a travel agent.
Plans are a starting point
Plans are written with AI from public sources and place data such as Google Maps. Opening hours, prices, availability, event schedules and entry rules change, and AI can make mistakes, so check the details that matter to you, including bookings, visas, and health and safety advice, before you rely on them.
Your account
Both consumers and businesses can use Highlights. You can start as a guest; to keep your trips across devices, to buy, and for some features, you sign in with an emailed code, Apple or Google. Give us complete and accurate details, keep access to your email and sign-in methods safe, and tell us right away at support@winding.ai if you think your account, sign-in or personal data has been misused, disclosed or stolen. You're responsible for everything that happens under your account.
Closing your account. You can stop using Highlights and delete your account at any time, in the app or by emailing support@winding.ai. Our Privacy Policy explains what we delete and what we keep.
Suspension. We may suspend or delete, at our discretion, at any time and without notice, accounts that we consider inappropriate, offensive or in breach of these terms. That doesn't entitle you to compensation, damages or reimbursement, and when the suspension is caused by you, it doesn't cancel fees you owe.
Buying on Highlights
- One-time purchases. Purchases on Highlights are one-time payments of the price shown at checkout, in the currency shown.
- Payment. Stripe processes our payments. You can pay by card or with the wallets Stripe offers at checkout, such as Apple Pay. Your card details go directly to Stripe; we never see or store them.
- Delivery. What you buy is digital. We deliver it by a link in an email to the address you gave at checkout, and in your account in the Highlights app. Plans that are ready arrive as soon as your payment goes through; plans we make or personalize for you arrive when they're ready, and custom plans within the time shown when you order.
- Refunds. Purchases shown with a 7-day refund at checkout can be refunded within 7 days of purchase: email support@winding.ai from the address you used at checkout. For a custom plan, if we miss the delivery time shown or you're not happy with the first version, you get your money back. Refunds go back to your original payment method.
- Advisor fees. A fee you pay a travel advisor through Highlights goes to that advisor, as shown at checkout.
If you're a consumer, you may also have rights under the law where you live, and nothing in these terms limits them.
Buying on Etsy or Fiverr
We also sell Highlights plans on marketplaces such as Etsy and Fiverr. If you buy there, that marketplace's terms, including its payment, delivery and refund rules, also govern your order. Your use of Highlights itself, including any account you use to open your plan, is governed by these terms.
Your content
You can add content to Highlights: prompts, trip details, edits, chat messages, names, profile details, and trips you publish. By adding it, you confirm that you're allowed to and that it doesn't break the law or anyone's rights.
You give us a non-exclusive, fully paid-up, royalty-free license to process your content only as needed to operate and maintain Highlights, for example to store it, show it to the people you share it with, and send it to the AI models that edit your trip. To the extent the law allows, you waive moral rights in content you add. Content you add is subject to the same general conditions as other content on Highlights.
When you share a trip by link, anyone with the link can see it; when you publish a trip or a creator profile, anyone can.
You're solely responsible for content you add. We don't screen it, but we may remove or block it, and deny you access to Highlights, without notice: when we learn it may break these terms, the law or anyone's rights; when we receive a notice of intellectual property infringement, or of a violation of someone's privacy, including their intimate privacy; when a public authority orders it; or when it may put users, others or the availability of Highlights at risk. Removal doesn't entitle you to compensation, damages or reimbursement. You agree to hold us harmless from claims made, and damage suffered, because of content you add.
Our content
Unless stated otherwise or clearly recognizable, the content on Highlights, including the plans we make, the Highlights name, Sally, logos, illustrations, design and software, belongs to us or our licensors, is protected by intellectual property laws and treaties, and we reserve all rights in it. Place details, photos and reviews from third parties such as Google remain theirs.
You may use plans you make or buy for your own personal, non-commercial travel, and share them with Highlights' sharing features, keeping attributions in place. Otherwise, you may not copy, download, share, modify, translate, publish, transmit, sell, sublicense, transfer or make derivative works from our content, or let anyone else do so, unless we've said you can. Statutory exceptions to copyright are unaffected.
You may not reproduce, copy, sell, resell or exploit any part of Highlights without our prior written permission, given directly or through a reselling program such as our creator and advisor features.
We do our best to make sure content on Highlights breaks no laws or third-party rights, but that isn't always possible. If you think something infringes your rights, please tell us at support@winding.ai.
Links to other services
Highlights links to and shows information from services run by others, such as Google Maps, booking and ticket sites, event organizers and the app stores. We don't control them and aren't responsible for their content or availability; their own terms apply. We're not a party to purchases or bookings you make with them.
Acceptable use
Use Highlights only for what it's made for, under these terms and the law; you're responsible for making sure your use doesn't violate any law, regulation or anyone's rights. To protect our legitimate interests we may deny you access, end our agreement with you, and report misconduct to the competent authorities if you violate laws, regulations or these terms, infringe anyone's rights, seriously harm our legitimate interests, or offend us or anyone else.
Liability
Unless explicitly stated otherwise or agreed with you, our liability for damages in connection with these terms is excluded, limited or reduced as far as the law allows.
Indemnification
You agree to indemnify and hold harmless us and our subsidiaries, affiliates, officers, directors, agents, co-branders, partners and employees against any claim or demand by a third party, including lawyers' fees and costs, arising from your culpable breach of these terms, of third-party rights or of the law in connection with your use of Highlights, to the extent the law allows.
Limitation of liability
Unless explicitly stated otherwise and without affecting applicable law, you have no right to claim damages from us or anyone acting on our behalf. This doesn't apply to damage to life, health or physical integrity, damage from a breach of essential contractual obligations, or damage caused by intent or gross negligence, as long as you used Highlights properly. Unless damage was caused by intent or gross negligence, or affects life, health or physical integrity, we're liable only for damage that was typical and foreseeable when the agreement was made.
Australian users
Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or similar State and Territory legislation that can't be excluded, restricted or modified. To the fullest extent the law allows, our liability to you, including for a breach of such a right, is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
US users
Disclaimer of warranties. Highlights is provided strictly "as is" and "as available", and you use it at your own risk. To the fullest extent the law allows, we disclaim all conditions, representations and warranties, whether express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information you get from us or through Highlights creates a warranty not stated here. Without limiting this, we and our subsidiaries, affiliates, licensors, officers, directors, agents, co-branders, partners, suppliers and employees don't warrant that content is accurate, reliable or correct; that Highlights will meet your needs; that it will be available at any particular time or place, uninterrupted or secure; that defects or errors will be corrected; or that it's free of viruses or other harmful components. Anything you download through Highlights is at your own risk, and you're responsible for any damage to your device or loss of data that results. We don't warrant, endorse, guarantee or assume responsibility for any product or service offered by a third party through Highlights or a linked site, and we don't monitor transactions between you and third-party providers. Highlights may not work with every browser, device or operating system. Some jurisdictions don't allow excluding implied warranties, so some of these exclusions may not apply to you, and you may have other rights that vary from state to state.
Limitation of liability. To the fullest extent the law allows, we and our subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees are not liable for: indirect, punitive, incidental, special, consequential or exemplary damages, including loss of profits, goodwill, use or data, arising from use of or inability to use Highlights; damage, loss or injury from hacking, tampering or other unauthorized access to or use of Highlights, your account or its information; errors, mistakes or inaccuracies in content; personal injury or property damage of any kind resulting from your access to or use of Highlights; unauthorized access to our servers and the personal information stored on them; interruption of transmission to or from Highlights; bugs, viruses or the like passed through Highlights; errors or omissions in content, or loss or damage from using content posted, emailed or otherwise made available through Highlights; or the defamatory, offensive or illegal conduct of any user or third party. In no event is our liability more than what you paid us in the 12 months before the claim, or during the time this agreement has been in place, whichever is shorter. This applies whatever the legal basis of the claim (contract, tort, negligence, strict liability or otherwise), even if we were told such damage was possible. Some jurisdictions don't allow these limitations, so they may not apply to you.
Indemnification. You agree to defend, indemnify and hold harmless us and our subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers and employees from all claims, demands, damages, obligations, losses, liabilities, costs, debt and expenses, including legal fees, arising from: your use of Highlights, including data or content you send or receive; your breach of these terms, including any of their representations and warranties; your violation of third-party rights, including privacy and intellectual property rights; your violation of any law, rule or regulation; content submitted from your account, including by others using your sign-in, and including misleading, false or inaccurate information; and your willful misconduct.
Changes and interruptions
To keep the service working well, we may interrupt it for maintenance, updates or other changes, and we'll let you know appropriately. Within the limits of the law, we may also suspend or end Highlights altogether. If we end it, we'll work with you so you can retrieve your personal data and information, and we'll respect your rights to continued use of products or to compensation as the law provides. Highlights may also be unavailable for reasons outside our reasonable control, such as force majeure events like infrastructure failures or blackouts.
Other terms
- No waiver. If we don't enforce a right or provision of these terms, that isn't a waiver of it, and no waiver is a continuing waiver of that or any other term.
- Changes to these terms. We may change these terms at any time, and we'll tell you appropriately when we do. Changes apply from the date we tell you. If you keep using Highlights you accept the new terms; if you don't want to, stop using Highlights, and you can end our agreement. The previous version governs the time before you accept the change, and you can ask us for any previous version. Where the law requires it, we'll tell you in advance when changes take effect.
- Assignment. We may transfer, assign, novate or subcontract our rights and obligations under these terms, taking your legitimate interests into account. You may not assign or transfer yours without our written permission.
- Privacy. Our Privacy Policy and Cookie Policy explain how we use personal data.
- Contact. Send all communications about Highlights to the contact details in these terms.
- Severability. If any provision is or becomes invalid or unenforceable under applicable law, the rest remain in full force. EU users: we'll both try, in good faith, to agree on valid provisions to replace void ones; failing that, applicable statutory provisions replace them where the law allows. An invalid provision voids the whole agreement only if it's essential, so important that neither of us would have agreed without it, or if the remaining provisions would be an unacceptable hardship for either of us. US users: an invalid provision will be interpreted and reformed as far as reasonably needed to make it valid and consistent with its original intent. These terms are the entire agreement between you and us on their subject and replace all earlier communications and agreements about it; they'll be enforced to the fullest extent the law allows.
Governing law and courts
These terms are governed by the law of the State of Nevada, USA, where we're based, without regard to conflict-of-law principles. If the law of the country you live in gives consumers more protection, that higher protection prevails. If you're a consumer in Switzerland, Swiss law applies. If you're a consumer in Brazil and the product or service is sold in Brazil, Brazilian law applies.
The courts of the place where we're based (Henderson, Nevada, USA) have exclusive jurisdiction over any dispute arising from or connected to these terms. This doesn't apply to consumers in the European Union, the United Kingdom, Switzerland, Norway or Iceland, or to consumers in Brazil.
